On the morning of May 18, 2018, a Kurowski Shultz Trial Team, led by Partner David Fisher, was awarded a defense directed verdict at the close of Plaintiff’s case. The case of Robert Friedman versus American Biltrite Inc. was pending in Los Angeles County Circuit Court in Van Nuys.  The decision was rendered by Judge Frank J. Johnson. 

The Court determined that the Plaintiffs failed to elicit sufficient testimony to support causation to the Defendant’s asbestos-containing floor tile as a matter of law.  The Plaintiff, 83 years old, claimed that he contracted mesothelioma as a result of being a bystander to a floor install in his home in 1966.  American Biltrite was the only remaining Defendant at the trial.

Plaintiff called as expert witnesses, Steven Paskal, CIH, and Dr. James Dahlgren.  Plaintiff was represented by Peter Beirne and Michael Reid of Weitz & Luxenberg of Los Angeles.  The defense trial team consisted of David Fisher and Kyle Stevens of Kurowski Shultz and Brent Karren of the MG&M office in Los Angeles.
