On September 26, 2018, a Kurowski Shultz trial team, led by partner David Fisher along with partner Kyle Stevens, secured a defense verdict in a peritoneal mesothelioma death case in Rochester. 

The jury deliberated under two hours in finding that the floor tile of the firm’s client, American Biltrite (ABI), was not a substantial factor in causing the disease of  local resident Jo Ann Shields.  Shields claimed she was exposed to the Amtico floor tile of ABI while working at Rochester Linoleum and Carpet Company  in the 1970’s and 1980’s.   A former warehouse manager disputed the claim.   The plaintiff was represented by Don Blydenburg of Levy Konigsberg in New York City.   Plaintiff called as expert witnesses Dr. Stephen Markowitz of New York City,  historian David Rosner of New York City and geologist Wm Egeland of MAS in Atlanta.  ABI called John Spencer, CIH of Wilmington, NC, Dr. James D. Crapo of Denver and tile expert Frank Prudenti of Brooklyn, New York.  

This was the second defense verdict in four months for Fisher who was awarded a directed verdict in a mesothelioma case in Los Angeles in May for ABI in Friedman v. ABI.
