David Fisher Obtains Favorable Verdict in 15-Day Asbestos Trial

A Kurowski Shultz Trial Team led by partner David Fisher obtained a favorable verdict in an asbestos case in Syracuse, New York on Thursday December 4, 2014.

In the case of John Colasanti vs. American Biltrite, the jury returned a verdict of $400,000.00 finding American Biltrite only 3.57% liable and the Plaintiff 75% responsible due to smoking. The net verdict was $15,000.00 which it is believed will be off-set by settlements such that American Biltrite will owe nothing from the verdict. Plaintiff was represented by Weitz & Luxenberg of New York City. He sought over $10,000,000.00 in damages in closing argument. The defense team included Mr. Fisher and the New York City firm of Wilson Elser served as local counsel.

The trial took place in Onondaga County, Syracuse, New York and was tried before the Honorable Charles Merrell. The trial took 15 trial days over four weeks and the jury deliberated for two days.
