Missouri Legislature Currently Working on Tort Reform Measures

The second half of Missouri’s 2018 legislative session kicks off today with Republicans planning to push tort reform – legislation designed to reduce the number of lawsuits filed in Missouri. 7th and 8th Circuits Split on Removal Requirements of Federal Question Cases Involving Multiple Defendants

Civil defendants in state court have the option to remove a case to federal court, and one basis for removal is when the case presents a “federal question.”  Federal question cases arise under the Constitution or laws of the United States. See 28 U.S.C. § 1441 (2011). But when there are multiple defendants in a case and removal is based solely on a federal question, “all defendants” must “join in or consent to the removal of the action.” 28 U.S.C. § 1446 (b)(2)(A) (2011) (emphasis added).
